Man bailed on charge of sending offensive (read, facts about illegal invasion, 15,000 dead civilians - Bruce .H.) email to US Embassy
Peace activist Bruce William Hubbard was remanded on bail when he appeared in North Shore District Court today on a charge of misusing a telephone.
The 38-year-old, accused of sending an offensive email to the United States Embassy in Wellington, was granted bail that included a condition that he not go within 250m of the Citibank building in Auckland, home to the United States Consulate General's office.
But when Hubbard and a dozen or so supporters protesting the United States presence in Iraq read the bail form outside the court they roared with laughter.
The form contained the condition that the Epsom student was not go within 250km of the bank.
Hubbard, appearing before Judge David Wilson, was represented by duty solicitor Sam Fernando who indicated Hubbard would plead not guilty and sought an adjournment for a status hearing next month.
When Judge Wilson began setting the bail conditions Hubbard, standing in the prisoners' dock, interrupted: "This is a freedom of speech issue. I don't feel I've done anything wrong."
Judge Wilson set conditions that Hubbard reside at his Manukau Rd address, that he not associate with the complainant, Tessa Brown, and that he not email the US Embassy.
When Judge Wilson got to the fourth condition of not going near the Citibank building Hubbard said: "I can't accept that. That's restricting my freedom."
Hubbard was told that what was being discussed was whether he would be released on bail or held in custody.
Hubbard said he was involved in an organisation which might require his attendance at the building in the "near future."
Judge Wilson set Hubbard's next appearance date at December 10 prompting Hubbard to remark: "Is that Human Rights Day?"
Judge Wilson told Hubbard human rights were important in court and asked him to co-operate.
The judge told Hubbard he could not go within a radius of 250m of the Citibank building.
