FOR A CITY COUNCIL RESOLUTION UPHOLDING CONSTITUTIONAL RIGHTS 




Dear friend of civil liberties:   
  
Since the tragic events of September 11, 2001, an avalanche of
repressive 
laws, executive orders and court decisions have severely endangered our 
civil liberties in the name of the "war on terrorism." However, while
the 
government has a right and a responsibility to protect public safety, it

should be kept in mind that the movement towards curbing civil rights
began 
well before September 11, 2001. A critical step in curbing civil rights
was 
the Antiterrorism and Effective Death Penalty Act of 1996, which was 
enacted in the aftermath of the Oklahoma bombing. 

Many of the more recent measures, including the USA PATRIOT Act, the 
Homeland Security Act and others represent the greatest threats to the 
First Amendment, due process and other constitutional rights that we
have 
seen in many decades. And the Ashcroft Justice Department has not
finished; 
it is about to introduce more legislation, originally titled the
Domestic 
Security Enhancement Act of 2003, which will strike hammer blows against

our rights, going so far as to make it possible for the government to 
revoke the US citizenship of both born and naturalized citizens under
some 
circumstances. 

To respond to this threat, more than 90 city and town councils and
boards 
around the country have passed resolutions calling for the offending 
legislation and policy directives to be repealed or reversed. You can
read 
the text of all of these resolutions on the Internet at

In Chicago, long term defenders of civil and constitutional rights have 
come together to advance this fight.  We have formed the CHICAGOLAND 
COALITION FOR CIVIL LIBERTIES AND RIGHTS.  Initial member organizations
are 
the American Civil Liberties Union-Illinois Chapter, The Chicago
Committee 
to Defend the Bill of Rights, the National Lawyers Guild-Chicago
Chapter, 
the Clarence Darrow Commission for First Amendment Freedoms of the 
Unitarian-Universalist Fellowship, the Muslim Civil Rights Center, and
the 
Loyola University Campus Greens Organization.  This new entity has 
undertaken the task of getting the Chicago City Council  and cities in
the 
Chicago suburbs to pass a resolution on civil liberties, which follows

A RESOLUTION ON THE USA PATRIOT ACT FOR CHICAGO CITY COUNCIL 

WHEREAS the City of Chicago recognizes the Constitution of the United 
States of America to be the supreme law of the land, and 

WHEREAS the U.S. and Illinois constitutions both protect freedom of 
religion, speech, press and assembly, as well as the right to due
process 
in all legal proceedings, and 

WHEREAS our long held standards of personal liberty and limited
government 
require that these rights be strictly observed by all government
officials 
and bodies, and 

WHEREAS it is vitally necessary to protect our nation and city against 
terrorism, and 

WHEREAS the means used to fight terrorism, like those used to combat
other 
crimes, must not be allowed to infringe on basic free expression and due

process rights, and 

WHEREAS the USA PATRIOT Act of 2001 contains many provisions which
infringe 
on our basic rights as U.S. citizens, permanent residents, and
nonimmigrant 
residents of Chicago, and 

WHEREAS the USA PATRIOT Act includes an impermissible broadening of the 
definition of terrorism to include many actions that are not terrorism
but 
might take place in forms of legitimate protests such as demonstrations
and 
strikes, and 

WHEREAS the USA PATRIOT Act also contains measures which marginalize 
judicial review and give the executive branch of the federal government 
dangerous power to eavesdrop on telephone and Internet communications,
to 
monitor reading habits, to detain and deport non-citizens without 
traditional due process, and to carry out surreptitious searches of
homes 
and offices on the basis of secret warrants issued by the Foreign 
Intelligence Surveillance Act court, and 

WHEREAS Title II of the 2002 Homeland Security Act creates a Directorate
of 
Information, Analysis and Infrastructure Protection with a broad mandate
to 
(a) compile and integrate information from government and private
sources 
with the aim of establishing vast, centralized data-bases on virtually 
everyone the United States, and (b) share these data with multiple 
government agencies without sufficient controls to protect civil
liberties 
and privacy, and 

WHEREAS, despite the already massive curtailment of civil liberties in
the 
USA PATRIOT Act, the U.S. Department of Justice is now considering 
legislation tentatively named the DOMESTIC SECURITY ENHANCEMENT ACT OF 
2003, which contains even more threats to fundamental rights, including 
stripping born and naturalized citizens of their United States
citizenship 
on the basis of even non-violent political activities and associations,
and 

WHEREAS the President of the United States has claimed an unlimited 
authority to declare anyone in the world, including any U.S. citizen, an

"enemy combatant," thereby depriving that person of all procedural
rights 
without possibility of challenge and for the indeterminate duration of
the 
"war on terrorism," and 

WHEREAS the federal government has been carrying out large-scale
roundups 
and interrogations of people from certain countries without regard to
due 
process but turning up little or no information useful to criminal 
investigations, and 

WHEREAS the City of Chicago recognizes that the aforementioned measures 
represent a serious danger to our civil liberties and to the principle
of 
checks and balances and separation of powers enshrined in the US 
Constitution, as well as being unnecessary and even counterproductive in

the fight against terrorism, and 

WHEREAS the City of Chicago recognizes that such infringements on our 
constitutional rights, by any government employee or official body
acting 
under color of law, represent a breach of public trust, a
misappropriation 
of public resources, a violation of civil rights and are thereby 
impermissible under the federal and state constitutions, 

IT IS THEREFORE RESOLVED that the City of Chicago reasserts its
commitment 
to the punctilious protection of First Amendment and due process rights
of 
all persons in the city, whether United States citizens or not, and 

IT IS FURTHER RESOLVED that the City of Chicago including the Department
of 
Police and all other bodies and individuals acting under color of City
of 
Chicago Authority will refrain from violating these rights, and 

IT IS FURTHER RESOLVED that the City of Chicago joins communities 
throughout the United States of America in expressing its concern about 
those measures, including but not confined to the USA PATRIOT Act and
the 
projected Domestic Security Enhancement Act, and 

IT IS FURTHER RESOLVED, and it is the policy of the City of Chicago in
the 
absence of probable cause of criminal activity to forbid any individual
or 
agency from 

1. Participation or cooperation in any inquiry, investigation
surveillance, 
or detention; and 

2. The recording, filing, and sharing of any intelligence information 
concerning any person or organization, even if authorized by federal law

enforcement authorities under the terms of the USA PATRIOT Act, the 
Homeland Security Act, the projected Domestic Security Enhancement Act
or 
Executive orders: this includes the collection and review of library 
lending and research records, as well as book and video store sales and 
rental records; and 

3. The retention of intelligence information: information currently held
by 
bodies or persons acting under color of City of Chicago corporate
authority 
shall be reviewed by a specially appointed independent outside entity to

ascertain whether it relates to a criminal investigation and was
collected 
on adequate bases of "probable cause", and if the information does not
meet 
this constitutional test, persons and organizations whose activities
were 
the subject of the surveillance involved will have the right to inspect
the 
material, which will thereafter be permanently disposed of; and 

IT IS FURTHER RESOLVED that the Chicago Police Department will not 
voluntarily participate in the enforcement of immigration matters, which

are entirely the responsibility of the federal government; no city
service 
will be denied on the basis of immigration status; and 

IT IS FURTHER RESOLVED that no city official or agency will participate
in 
profiling based on race, ethnicity, religion, citizenship or immigration

status, or political values or constitutionally protected political 
activities, and 

IT IS FURTHER RESOLVED that any state, county or federal law enforcement

agencies or agents working in the City of Chicago be required to comply 
with the terms of this resolution, and that they submit a regular
report, 
involving precise information about persons detained and held in the 
Chicago area, or Chicago residents held elsewhere, to the City of
Chicago, 
which shall make this information available to the public, and 

IT IS FURTHER RESOLVED that the City of Chicago encourages all
inhabitants 
of Chicago to refuse to cooperate with activities that would violate the

First Amendment, due process, and other constitutional rights, and 

IT IS FURTHER RESOLVED that the City of Chicago calls upon the Illinois 
Congressional delegation to work for the REPEAL of the USA PATRIOT act
and 
the Homeland Security Act, and the defeat of the proposed Domestic
Security 
Enhancement Act of 2003, and 

IT IS FURTHER RESOLVED that the City of Chicago calls upon the U.S. 
Congress and courts to strike down the abuse of Presidential power
embodied 
in the "enemy combatant" designation, and 

IT IS FURTHER RESOLVED that the City Clerk communicate this resolution
to 
all city departments, to the governor and the Attorney General of the
State 
of Illinois, to the President and the Attorney General of the United
States 
of America, and to the public, and 

IT IS FINALLY RESOLVED that this resolution shall be severable if any 
phrase, clause, sentence or provision of this resolution is declared by

court of competent jurisdiction to be contrary to the Constitution of

IS FURTHER RESOLVED that the Chicago Police Department will not =
<BR>voluntarily=20
participate in the enforcement of immigration matters, which <BR>are =
entirely=20
the responsibility of the federal government; no city service <BR>will =
be denied=20
on the basis of immigration status; and <BR><BR>IT IS FURTHER RESOLVED =
that no=20
city official or agency will participate in <BR>profiling based on race, =

ethnicity, religion, citizenship or immigration <BR>status, or political =
values=20
or constitutionally protected political <BR>activities, and <BR><BR>IT =
IS=20
FURTHER RESOLVED that any state, county or federal law enforcement =
<BR>agencies=20
or agents working in the City of Chicago be required to comply <BR>with =
the=20
terms of this resolution, and that they submit a regular report, =
<BR>involving=20
precise information about persons detained and held in the <BR>Chicago =
area, or=20
Chicago residents held elsewhere, to the City of Chicago, <BR>which =
shall make=20
this information available to the public, and <BR><BR>IT IS FURTHER =
RESOLVED=20
that the City of Chicago encourages all inhabitants <BR>of Chicago to =
refuse to=20
cooperate with activities that would violate the <BR>First Amendment, =
due=20
process, and other constitutional rights, and <BR><BR>IT IS FURTHER =
RESOLVED=20
that the City of Chicago calls upon the Illinois <BR>Congressional =
delegation to=20
work for the REPEAL of the USA PATRIOT act and <BR>the Homeland Security =
Act,=20
and the defeat of the proposed Domestic Security <BR>Enhancement Act of =
2003,=20
and <BR><BR>IT IS FURTHER RESOLVED that the City of Chicago calls upon =
the U.S.=20
<BR>Congress and courts to strike down the abuse of Presidential power =
embodied=20
<BR>in the "enemy combatant" designation, and <BR><BR>IT IS FURTHER =
RESOLVED=20
that the City Clerk communicate this resolution to <BR>all city =
departments, to=20
the governor and the Attorney General of the State <BR>of Illinois, to =
the=20
President and the Attorney General of the United States <BR>of America, =
and to=20
the public, and <BR><BR>IT IS FINALLY RESOLVED that this resolution =
shall be=20
severable if any <BR>phrase, clause, sentence or provision of this =
resolution is=20
declared by a <BR>court of competent jurisdiction to be contrary to the=20
Constitution of the <BR>United States of America or the State of =
Illinois. If=20
the applicability <BR>thereof to any agency, person or circumstances is =
held=20
invalid, the <BR>validity of the remainder of this resolution and the=20
applicability thereof <BR>to any other agency, person or circumstances =
shall not=20
