Hello New IMC Group,

Below is the mediation agreement the SF-IMC consensed
upon when deciding to split up. I should have sent it
along with the New IMC application for the San
Francisco IMC, but I did not.

Our group spent over 16 hours in mediation which cost
a lot of money. And unfortunately the agreement is not
being upheld by the group that got to keep
sf.indymedia.org.

The SFBAY-IMC was supposed to get indybay.org as one
of the domain names. And we were also supposed to get
a blurb and link to our site from sf.indymedia.org.
The new San Francisco has refused to do these things.

Without owning indybay.org, the new San Francisco IMC
has the power to point it away from our site at
anytime. Without a link to our site from
sf.indymedia.org very few people will be able to find
our site, and the few people in the new San Francisco
IMC will keep the audience it took years for us all to
build up, in effect, they will be keeping the rewards
of years of other people's work.

We are asking for the new San Francisco IMC to turn
over ownership of indybay.org to the SFBAY-IMC
immediately and to link to our site as per the
agreement. If this does not happen, we would like to
ask the New IMC group to re-consider the San Francisco
IMC's new IMC application.

SF-IMC SPLIT AGREEMENT - CONSENSED UPON ON NOV 13,
2003

*****SECTION 1 - Domain Name

a) Ryan & Noah's group will get sf.indymedia.org &
will need to go through new IMC process.
Sf.indymedia.org will have a prominent link and center
column blurb about the SF Bay Area IMC on their front
page. The center column blurb will stay up for 3
months, the link will remain up permanently. The SF
Bay Area IMC will not block or impede their new IMC
application, and the new IMC will be recognized by the
SF Bay Area IMC.

b) The SF Bay Area IMC will change their DNS to
sfbay.indymedia.org & indybay.org. The SF Bay Area IMC
will not have to go through new IMC process, since
they are remaining the SF Bay Area IMC.
Sfbay.indymedia.org & indybay.org will have a
prominent link and center column blurb about Noah &
Ryan's IMC on their front page. The center column
blurb will stay up for 3 months, the link will remain
up permanently. 

c) An email consensed upon by both IMCs will be
presented to global Indymedia as a cover letter/blurb
to the New IMC group with the new IMC application
explaining the mediation process we went through and
the decision that we came to. Lisa will draft up this
email, to be consensed upon by both groups by Monday.

d) Site software/database of articles/uploaded files
Will be copied and shared 

e) Jurisdiction 
People can decide for themselves what IMC they want to
be involved in, regardless of where they live. 

f) Working Arrangements 
There will be nothing official saying that Sunny, Mark
& Lisa can not work with the new IMC (and the same
goes for Noah & Ryan) - it will just be assumed that
these people won't want to work with each other and
will organize accordingly. 

g) SF-ACTIVE 
The conflict will not spill over into the SF-Active
working group. There was a acknowledgement that Noah &
Ryan would not try to kick Mark out of the SF-Active
Working group. 

h) Clarification on blurb and link 
There will be an identical (small) blurb in the center
column of each site for three months. The 1st month it
will be the top story, the 2nd month, it will be the
2nd story, and the 3rd month it will be the 3rd story.
Ian will draft the blurb by Monday, the blurb must be
accessible to all. The permanent link to each site
respectively will be prominent near the top of each
web site. 

i) Negative Propaganda 
Neither IMC will engage in negative propaganda about
the other. No one involved in either IMC should ever
tell people "don't post to the other IMC" or "The
other IMC is not trustworthy." Publicly we should all
support both IMCs and respect their existence in the
Bay Area and continue to be a resource for the
community (no sabotaging each other!). 

*****SECTION 2 - Financial Resources 

a) Credit Union Account The SF Bay Area IMC will
retain the account. The money will be split 50/50
between both groups. The SF Bay Area IMC will get an
additional $300 to equal what was given to Noah for a
"tech slush fund". 

b) Slush fund - Will be split evenly between both
groups 

c) Media Alliance fiscal sponsorship 
The SF Bay Area IMC will remain fiscally sponsored by
Media Alliance. The new IMC will be responsible for
finding their own fiscal sponsor. 

d) Paypal Account 
Will be retained by the SF Bay Area IMC, since it is
connected to the checking account that they will
retain. 

e) Financial Timeline 
Money will be transferred to new IMC by 11/21 

*****SECTION 3 - Tech Resources 

a) Gauss / transbay donation 
The SF Bay Area Imc will retain responsibility for it

b) Stray-Black cat - is a linefeed server and will be
retained by linefeed 

c) Werner - will be returned to josh, he can do what
he wants to it. 

d) Three pc laptops in the back office - One goes to
each Imc, and one goes to Nana 

e) Rack-mounted server - Will go to the SF Bay Area
IMC and host sfbay.indymedia.org & indybay.org 

f) Sfimc.net - will go to Ryan & Noah's IMC 

SECTION 4 - Audio Resources 
a) enemycombatantradio.org - will be the
responsibility of the Enemy Combatant Radio collective

b) The name "enemy combatant radio" - will be retained
by the Enemy Combatant Radio collective 

c) Minidisc recorders - will go to the SF Bay Area IMC

d) Enemy combatant radio mp3 archives - goes to both
new IMCs 

*****SECTION 5: - Mailing lists 

a) Indymedia Mailing lists / Aliases 
All requested to be turned off. Each group is
responsible for creating new mailing lists. 

b) Linefeed-sponsored Mailing lists (imc-sf-urgent) 
All requested to be turned off 

c) Indybay Mailing List on Yahoogroups 
Remain runing as-is, not used for anything but still
functioning 

*****SECTION 6: Space Resources 

a) The Space and all computer equipment in it,
including the telephone line, will remain the
responsibility of the SF Bay Area IMC. 

b) The Radio Office will remain the responsibility of
the Enemy Combatant Radio Collective 

c) Vacating space timeline 
Noah & Ryan's group will be out of the SF Bay Area
space by December 31. They will send a list of items
(with their estimated cost) that remain in the space
to the SF Bay Area IMC, so that the SF Bay Area IMC &
Suite 216 can figure out how to replace them, or if
they will need to purchase them from the owners of the
equipment. This list will be given to the SF Bay Area
IMC by Dec 15. 

*****SECTION 7: Misc Resources 

a) Stickers/T-shirts - purchased by Ryan & Noah's
group for a price (t-shirts were $5 each, plus tax… we
purchased about 500 of them)

b) Police Scanners - retained by Ryan & Noah's group 

c) Press Passes Peter will send a clarifying letter to
SFPD letting them know that there are 2 groups now. He
will send out to int list for approval by Monday.
